1. Who this policy covers
This Privacy Policy explains how Le Mans Distributors (“we”, “us” or “our”) handles personal information in connection with this website, business enquiries and customer relationships in South Africa. It is intended to reflect the Protection of Personal Information Act 4 of 2013 (POPIA).
For privacy requests, email hello@lmd.co.za, marked “Privacy / Information Officer”, or write to 112 Richards Dr, Halfway House, Midrand, 1685, South Africa.
2. Information and sources
Depending on your interaction with us, we may receive your name, business name, contact details, delivery address, enquiry correspondence, and information needed to assess a trade account or fulfil an order. Please do not send identity documents, financial records or sensitive information unless specifically requested for a stated purpose.
We generally obtain information directly from you or an authorised representative of your business. If information is obtained from another source, such as a delivery partner or trade reference, we will provide the notices required by law. The forms temporarily use a one-way hash of a network address for abuse prevention. A hosting provider may also record technical information such as IP addresses, browser details and access logs when the website is hosted online.
3. Why information is used
Information may be used to respond to enquiries, assess stockist applications, prepare quotations, manage accounts and orders, arrange deliveries, provide support, keep required business records and protect our systems.
Processing must have an appropriate legal basis, such as consent, steps needed to enter into or perform a contract, a legal obligation, or a legitimate interest permitted by POPIA. Supplying enquiry information is voluntary, but we may be unable to respond or provide a requested service without the necessary details. We will identify mandatory information and any applicable legal requirement when requesting it.
5. Retention and security
Personal information should be kept only for as long as needed for its purpose, applicable legal record-keeping duties or the lawful resolution of disputes. When retention is no longer justified, records should be securely deleted, destroyed or de-identified.
We must take reasonable organisational and technical measures to protect personal information. No online service can guarantee absolute security. Where a security compromise occurs, we will notify the Information Regulator and affected people as required by law.
7. Your choices and rights
Subject to applicable legal requirements, you may request confirmation of whether we hold your personal information, access to it, correction of inaccurate information, or deletion of information that we are no longer entitled to keep. You may object to certain processing and withdraw consent where processing relies on it. Withdrawal does not undo processing that was lawful before withdrawal.
Email your request to hello@lmd.co.za. We may need proportionate proof of identity before releasing or changing records. Access requests may be handled under POPIA and, where relevant, the Promotion of Access to Information Act 2 of 2000 (PAIA). Any lawful fee, refusal or limitation will be explained.
8. Questions and complaints
Please contact us with privacy concerns. You may also complain directly to South Africa’s Information Regulator; you do not have to complete our internal process first. Current complaint channels and forms are available on the Information Regulator’s complaints page.
9. Changes to this policy
We may update this policy to reflect changes to the website, our activities or the law. The revision date will be shown above. Material changes affecting how information is used will be communicated where required.
